SUBJECT: Memorandum for INDEFINITE Delays by UNITECH in UNIHOMES SECTOR 117 Noida, Project.

We all UNITECH UNIHOMES –Sector 117 NOIDA Customers had booked flats in year 2009 and as committed by UNITECH Ltd, we were expecting our flats possession in two years. Now after more than two years of booking looking over at the present state of development we are extremely worried that our flats are not ready and still majority of work is in pending.  Some of the towers (e.g. E1, D1 etc tower in phase-2) are far back schedule and only 10% to 40% construction is done. We customers are facing huge monitory losses due to these delays by UNITECH and therefore we have been following UNITECH CRM Folks since more than one year now for accelerating the work. We have been committed with dates by UNITECH folks several times that construction will start in full swing but still negligible work is going in Phase-1 and NO WORK IS HAPPENING IN PAHSE-2 since past 8 months and even till now.

These are the low cost flats which are constructed by UNITECH and mostly middle class people have booked flats over here in a dream of getting own house which has now become a nightmare.

We are middle class common man and we booked our flats in full trust with UNITECH that our flats shall be delivered to us on time or may be with delay of maximum 6 months. Now delays have gone indefinite and would definitely be more than one year therefore we are getting financially shattered.  We are paying huge bank interests and same time we are paying heavy House Rent and therefore it is becoming difficult to run our livelihood.

UNITECH attracted our trust by putting a clause that UNITECH shall pay Rs 5 Per/Sqft as a penalty in case of delays. We trusted UNITECH that delays won’t be more than 6 Months therefore agreed with 5 Rs. Penalty Clause but now at this stage when delays are going indefinite and we realize that penalty of Rs 5 Per/Sqft is not a justice for us. This doesn’t appear as justice to us also because UNITECH has kept a clause that in case if we fail to pay the demands raised by UNITECH on time then we will be imposed with the penalty of 18% of the demand rose by UNITECH. Hence this agreement is only benefitting one side (i.e. UNITECH Ltd). This appears in more favor towards UNITECH.

We cannot afford such huge delays and big losses happening to us due to none of our fault. It is just the trust we did with UNITECH that we agreed with the penalty clause of just Rs 5per/Sqft and now feel that UNITECH is exploiting that by delaying indefinitely. We are paying 11% to 13% of interests to the banks on the loan which we borrowed from bank to pay UNITECH Demands. This amount is almost 10 times more than what we may get from UNITECH against penalty.

Looking forward we appeal that UNITECH must realize our pain in relation with them and make commitment with us on following:

  1. UNITECH should give exact possession date i.e. month and year (not tentative) to each individual customer for their respective UNITS. (Not like in UNITECH last letter it was mentioned that they will start possession in first phase from end of 2012). We want exact month and year that when UNITECH will deliver its Towers or UNITS (in both phase-1 and phase2). Please inform us accurately that when exactly; we will be getting possession of our UNITS because we have to plan accordingly for extension of lease of our rented house.
  2. We want UNITECH should organize a regular meeting every month between us and the UNIHOMES project heads to showcase progress.
  3. Since now delays have gone beyond more than 6 Months and further going indefinite therefore UNITECH should commit to pay us at least the compensation of same 18% as it applicable on us in case if we customers fail to pay demand to UNITECH on time. We want this also because we pay heavy Interest to the bank and the house rent to the landlords.

Above are the most basic commitments which we want from UNITECH for building trust going forward.

If Unitech wants to continue the work in full swing in Day & night shifts by arranging at least sufficient labouraround 1200 to 1500 Nos. civil labours(skill + unskill), 250 to 300 Nos.labours for services say Electrical, Mechanical & Plumbing side (MEP) and35 Nos. site staff manpower (Managers, Engineers, foremen, etc.) of their site office including 8 to 10 manpower for services/MEP side & rest around 25nos. staff for civil side, then they can complete the whole Project of phase-1& 2 in max. 7 months with complete handover with complete satisfaction asexplained as under:-1) The boundary wall work of 70 Acres land —-separete activity takes starting4-months. 2) The Electrical Sub station work – ( HT , LTwork)- separate activity takes 1- months from end and 2 months with basement work.3) RCC Underground tank & treatment plant- separate activity takes starting3.5 months simultaneously with basement work.4) Basement & Stilt covered Parking- separate activity takes starting 4months from now.5) Internal Road work & Pathway – can take 2 months in the summer April,& may 6) Gate House (Security Room with gate)- takes last one month7) External Sanitary & Plumbing work (Sewage line)- simultaneous activityin coordination with road takes 2 months only.8) External Electrical work9) Landscaping work — takes last 2-months10) Shops — takes last 1-months11) Many Miscellaneous activities — takes last 2 months from end.If Unitech’s higher management feels some type of life & death pressure tocomplete the job in time i.e till Aug. 2012 to Sep.2012then they can arrange sufficient Manpower, material, money, management controlto complete the job in time of six to seven months from now.

We are now more than frustrated and facing deep mental agony due to financial loses and continuous ignorance by UNITECH Ltd on our request to accelerate the work and give our possession. This is the final notice and if this is not acknowledged and our demands mentioned in this letter are not taken seriously, we may have to do public protest, involve media and court.
